Texting, Walking...and a Ticket?

Should there be a law against texting while walking?
"Tuning in and tuning out can be a fatal combination on the streets of New York," says New York state Senator Carl Kruger (D-Brooklyn).  That's why he wants to make it illegal to use any electronic device while crossing the street.  The idea may not actually become a law, but if it does, it could mean a $100 ticket for listening to an MP3 player or calling a friend when you're walking from block to block.

What would you think of a law like this?  And let's say you get caught texting while walking in a place where that isn't allowed - what would you say to defend yourself?
